The time limit may not be the same as it would be for treatment in Scotland, and overseas providers may not offer follow-up care to the same standard you would expect in the UK. If your surgery was abroad, it helps to keep your booking papers, consent forms, receipts, photos, and any messages about aftercare.
How is cosmetic surgery compensation calculated?
There is no fixed amount. A claim’s value is typically determined by two factors: the severity of the harm and the real-world impact of the negligence on your life.
For example, compensation may take into account your pain, scarring, emotional distress, and any loss of confidence caused by the outcome. It can also cover the practical cost of what happened, such as lost earnings, travel expenses, care, and the cost of further or corrective treatment.
In simple terms, compensation for cosmetic surgery negligence is worked out by looking at both the injury itself and the financial impact it has had on you.
How does the No Win No Fee agreement work for Scottish claims?
In Scotland, this type of arrangement is often called a speculative fee agreement. It means the solicitor’s fee depends on the outcome of the case, rather than being paid in the usual way from the start.
