How No Win, No Fee Agreement Works
A no win no fee claim is meant to reduce the financial worry of starting a case. In Scotland, this is usually done through a success fee agreement. If the claim is unsuccessful, you would not normally pay the lawyer’s fee under that agreement. If the claim is successful, a success fee can be taken from your damages, but the amount is capped by Scottish law.
For personal injury claims in Scotland, the legal cap is up to 20% of the first £100,000 of damages, up to 10% of the next £400,000, and up to 2.5% of damages over £500,000, with VAT included in those caps. According to the regulation, if more than one provider is involved, only one total success fee can be charged, so there should not be separate extra percentages added on top.
That means you would be told clearly, before you sign anything, what percentage applies to your case and what happens to any unrecovered outlays or legal fees.
The Scottish system also gives personal injury claimants an added layer of protection through qualified one-way costs shifting, called QOCS. That is not an insurance policy, but it serves a similar purpose to ATE insurance by generally protecting a claimant from having to pay the other side’s expenses if court proceedings fail, although that protection can be lost in limited situations such as fraud, abuse of process, manifestly unreasonable conduct, or certain tender-related situations.
