Liposuction Compensation Claims

Check Out Our Awesome Reviews Below:

Liposuction is an invasive surgical procedure, so harm after treatment can feel frightening and deeply personal. If liposuction surgery is done poorly or aftercare is not good enough, you may be left with pain, infection, scars, uneven liposuction results, or nerve damage. Some people also face anxiety, low mood, body dysmorphia, or a loss of confidence.

At HD Claims, we help people in Scotland with liposuction claims after treatment at a private clinic, private hospital, or NHS hospital. You may have a medical negligence claim if your injury was caused by a surgical error, poor hygiene, poor aftercare, or a failure to explain the risks before undergoing liposuction.

We manage your case strategy from start to finish. We then work with a suitable medical negligence solicitor in Scotland for your type of claim. If your case is accepted, we can help you get clear legal advice and seek the compensation you deserve on a No Win No Fee basis.

We can also help you understand related cosmetic surgery concerns, including claims involving a tummy tuck gone wrong, breast surgery complications, facial cosmetic surgery, or other avoidable harm caused by substandard care.

What Is Liposuction Negligence?

Liposuction negligence is not the same as simply being disappointed with the final result. Cosmetic surgery involves medical judgement, and a claim will not usually succeed just because the outcome looks different from what you hoped for.

A claim may be possible if something went wrong because your surgeon, clinic, or hospital did not provide the level of care you should reasonably have received, and you were harmed as a result.

This may include poor planning, unsafe fat removal, poor aftercare, or errors on delicate areas of the body such as the abdomen, arms, thighs, hips, neck, or chin. These cases may fall under aesthetic surgery negligence if the care fell below a reasonable standard.

One critical issue is informed consent. According to the Montgomery ruling, a doctor must take reasonable care to explain material risks and reasonable alternatives so that the patient can make an informed decision.

If you were not warned about risks such as scarring, infection, uneven results, or nerve injury, and you would have refused the procedure or chosen a different option if properly informed, you may have a valid claim.

For example, you may not have a claim simply because the result is not as slim or smooth as expected. But you may have grounds for liposuction gone wrong compensation if a surgical error, poor hygiene, or lack of proper risk advice caused injury. These are the kinds of facts considered in surgical error negligence claims.

Can I Claim Compensation For Liposuction Gone Wrong?

You may be able to claim if your liposuction went wrong because the care you received was not safe or reasonable. This is different from simply feeling unhappy with the final shape. The main question is whether a surgeon, clinic, or hospital made an avoidable mistake that caused you harm.

Some liposuction injuries can be very serious. If a cannula is pushed too deeply, it may damage an organ such as the bowel or liver. Poor hygiene may lead to severe infection, sepsis, or blood poisoning. Too much fluid or anaesthetic, such as lidocaine, may also cause dangerous reactions.

Some claims are caused by uneven or excessive fat removal, which can change the shape of the treated area in a noticeable way. For example, botched arm liposuction may leave visible dents, hard lumps, or uneven contours that affect how you dress and feel day to day. In some cases, these effects can be long-term and may need corrective treatment.

It is also important to be fair about what liposuction can and cannot do. Liposuction permanently removes fat cells from the treated area, but it does not stop future weight gain after liposuction. A claim is more likely where the poor result was caused by unsafe technique, poor planning, lack of consent, or poor aftercare.

If your claim appears suitable, we can connect you with experienced liposuction surgery claims solicitors in Scotland.

Before undergoing liposuction in Scotland, patients should check that the private clinic or hospital is registered with Healthcare Improvement Scotland (HIS), as this helps confirm that the provider is subject to safety, staffing, hygiene, and inspection standards. If treatment took place in England, the relevant regulator is usually the Care Quality Commission (CQC).

How to Make a Liposuction Claim

Start by getting medical help. If you have pain, swelling, fever, leaking wounds, numbness, or signs of infection, contact your GP, NHS 24, or emergency services if symptoms are serious. Your health comes first, and these medical records can also help show what happened after the procedure.

Next, keep a clear record of the problem. Take date-stamped photos of bruising, scars, burns, uneven areas, or any change in shape. Save messages, consent forms, clinic letters, payment records, aftercare notes, and complaint replies.

You can also ask the cosmetic clinic or hospital for a copy of your medical notes. These may show what was discussed before surgery, what technique was used, who treated you, and what aftercare was given. Do not worry if you do not have everything yet; missing records can often be requested later.

When we review your case, we look at the full picture. This includes the surgery, your recovery, the advice you were given, and how the injury has affected your work, confidence, and daily life.

The solicitors we work with will also review your claim, and where suitable, we will also get expert opinion from an independent consultant plastic surgeon.

Time Limits For Liposuction Negligence Claims

In Scotland, most liposuction negligence claims must be raised within three years. This rule comes from the Prescription and Limitation (Scotland) Act 1973, which applies to personal injury claims. The clock usually starts on the date of the surgery, or the later “date of knowledge” if you only realised the problem was linked to negligence afterwards.

This matters because some liposuction injuries are not clear straight away. Swelling may hide uneven results for months. Numbness, scarring, or contour deformities may only seem permanent once healing has settled.

For example, you may first think the problem is normal bruising. Later, a doctor may tell you that the problem is not part of normal healing and may have been caused by poor surgical technique or unsafe aftercare. That later point may be your date of knowledge, but it is always safer to seek advice early.

Liposuction Compensation Calculator

A liposuction compensation calculator can only give a rough guide. In Scotland, the value of a claim depends on the injury, the recovery time, the effect on your appearance, and the proof available. No fair figure can be given until medical evidence has been reviewed.

Compensation is usually considered in two parts. Solatium covers pain, suffering, scarring, loss of confidence, and the emotional impact of living with a poor or harmful result. Patrimonial Loss covers measurable financial losses, such as lost wages, travel costs, care, private corrective treatment, revision surgery, or psychological therapy.

For example, a person with minor scarring may receive a very different amount from someone who needs reconstructive surgery, has lasting nerve pain, or cannot return to work for months. The solicitors we work with will look at both the medical harm and the real-life effect on your daily life to calculate a fair compensation figure.

Injury typeGuideline solatium estimates
Noticeable body scar or several superficial scars£3,130 to £10,350
Multiple body scars or one more significant scar to the arms, legs, back, chest, or abdomen£10,350 to £30,030
Moderate psychiatric injury, such as anxiety or depression with recovery likely£7,740 to £25,190
Moderately severe psychiatric injury affecting daily life, work, and relationships£25,190 to £72,450
Penetrating bowel injury causing some permanent damage£16,640 to £32,340
Severe abdominal injury affecting bowel function£58,920 to £92,130
Kidney damage with long-term interference but near-full recovery£30,930 to £41,370

FAQs

Can I claim if I am simply unhappy with the aesthetic results of my liposuction?

Usually, no. Being unhappy with the shape, size, or final look is not enough on its own. A claim is more likely where the result was caused by substandard care, such as poor technique, unsafe aftercare, lack of proper planning, infection, scarring, or avoidable injury.

It can. Your surgeon should explain the serious and relevant risks before treatment, so you can make an informed choice. If you were not warned about risks such as nerve damage, severe scarring, infection, uneven results, or organ injury, and you would have made a different decision (if you were properly informed), this may support a claim.

If your claim is accepted, the solicitors we work with will take your claim on a No Win No Fee basis. This means you would not have to pay legal fees up front. If the claim is successful, a success fee may be taken from your compensation, and this would be explained to you clearly before you decide to go ahead.

Compensation can cover pain, scarring, loss of confidence, and psychological harm. In Scotland, this is often known as solatium. It may also cover financial losses, known as patrimonial loss, such as lost earnings, travel costs, care costs, counselling, and private corrective surgery.

Useful evidence may include your medical records, consent forms, before-and-after photos, clinic messages, complaint replies, and proof of financial losses. An independent medical expert may also review whether your surgeon’s care fell below a reasonable standard.
