I cannot thank the team at HD Claims enough for their help with my personal injury claim. From day one, their injury lawyers were incredibly professional, explaining the no win no fee process clearly without complex jargon. They took away all the stress of dealing with the insurance companies and secured the accident compensation I was entitled to. If you are looking for reliable personal injury solicitors who truly look out for your best interests, I highly recommend their services.

My insurance company recommended a firm that charged 30% and had poor reviews. I went with Hamilton Douglas instead, who charged far less and were completely transparent. They were professional, communicative, and secured me an excellent settlement. Do your research and pick them.

Do You Have a Valid Personal Injury Claim in Kilmarnock?

A valid claim in Scotland requires three things: someone owed you a duty of care, they breached it, and that breach caused you a physical or psychological injury. This is called the tripartite test. It applies equally whether you were hurt on the A71, on a building site in Kilmarnock, or in a supermarket aisle.

Who owes a duty of care?

  • Employers owe it to their staff
  • Drivers owe it to everyone else on the road
  • Shops, venues, and businesses owe it to visitors under the Occupiers’ Liability (Scotland) Act 1960
  • Doctors and healthcare providers owe it to their patients
  • East Ayrshire Council owes it to people using the roads and footpaths it maintains

Breach means falling below the standard a reasonable person would meet, such as a driver pulling out without looking, or an employer who never trained you to lift safely. That breach must then have caused an injury that is more than trivial. Psychological injury counts where there is medical evidence to support it.

You do not need to figure this out yourself. We will guide you on whether your claim is valid.

Types of Personal Injury Claims We Handle in Kilmarnock & Surrounding Areas

We handle the full range of personal injury claims across East Ayrshire, from a whiplash injury after a shunt on the M77 to a catastrophic brain injury requiring lifelong care.

The sections below cover the types of personal injury claims we see most often in East Ayrshire. If your situation is not described here, ask us anyway, because we would rather give you an honest answer than leave you guessing.

Road Traffic Accident Claims on the M77, A77, A71, and Bellfield Interchange

Kilmarnock sits at one of the busiest junctions in south-west Scotland, where several major routes converge:

  • The M77 connects north to Glasgow and south to Ayr.
  • The A77 bypass carries heavy traffic further south towards Stranraer and the coast.
  • The A71, A735, and A76 bring drivers straight into the town centre.

In 2025, police recorded 115 people injured or killed in road collisions across East Ayrshire, including 5 fatalities and 33 serious injuries. A large share of accidents occur on routes residents use every day, including the M77, the A77 bypass, the A71 through the Irvine Valley, and the junctions around Bellfield Interchange.

Key points for road traffic claims:

  • Passengers have the same right to claim as drivers. Compensation is paid by the driver’s insurer, not the driver personally, so travelling with a friend or relative is no reason to delay or avoid making a claim.
  • Motorcyclists and cyclists are more vulnerable than drivers. Where a road surface defect caused a cycling crash, the claim is made against the roads authority rather than another driver.
  • Pedestrians are hurt every year at crossings with poor sightlines across Kilmarnock.
  • Whiplash is a genuine soft tissue injury, most often sustained after a rear-end impact. Recovery can take months. The fixed whiplash tariff used in England and Wales does not apply in Scotland, so your claim is assessed on its own facts.
  • Being hit by an uninsured or hit-and-run driver does not mean your claim is over. The Motor Insurers’ Bureau steps in where the other driver had no cover or cannot be traced.

Workplace, Industrial, and Factory Injury Claims in East Ayrshire

Sadly, workplace injuries happen more frequently in East Ayrshire than the national average. For people working in places like Moorfield Industrial Estate, Glencairn, or the various food processing sites across Kilmarnock.

The risks often come down to a few familiar dangers:

  • Manual handling causing back and shoulder injuries, most often where no safe system of work was in place
  • Forklifts and production plant causing crush injuries and fractures
  • Falling objects from racking in warehouse environments

Under the Health and Safety at Work etc. Act 1974, your employer is required to assess risk and protect you. Where those duties were neglected, you may have a factory injury compensation claim.

You cannot be dismissed or treated unfairly for making an injury at work claim. If you are, that is a separate employment tribunal matter, but act quickly: the deadline for bringing an unfair dismissal claim is generally three months minus one day from the date of your dismissal or the act complained of. You must also notify ACAS and complete the Early Conciliation process before a tribunal claim can be lodged, which can affect how that deadline is calculated. Missing the tribunal time limit is almost always fatal to that claim, even if your personal injury case is still ongoing.

Some injuries take years to appear.

We also handle industrial claims across East Ayrshire involving:

  • Asbestos-related conditions, including mesothelioma
  • Vibration white finger from powered hand tools
  • Occupational asthma from dust and fumes
  • Musculoskeletal disorders and repetitive strain injury
  • Occupational dermatitis

If your former employer has closed, the claim can still proceed. The Employers’ Liability (Compulsory Insurance) Act 1969 requires every employer to hold insurance, and that insurance remains valid after the company closes. The policy is traced through the Employers’ Liability Tracing Office, and the claim is pursued against the insurer directly.

Slips, Trips, and Public Liability Claims in Kilmarnock Town Centre

Every public liability claim in Scotland rests on the Occupiers’ Liability (Scotland) Act 1960, which requires anyone occupying premises to take reasonable care to ensure the safety of the visitors. If you were hurt in a shop, supermarket, restaurant, or pub in Kilmarnock, the business running those premises may be responsible.

Common dangers include:

  • Wet floors with no warning sign
  • Uneven surfaces and lifted paving
  • Unlit stairways
  • Cluttered walkways or obstructed exits

Under the Roads (Scotland) Act 1984, East Ayrshire Council also has a duty to maintain public roads and footpaths. Tripping on a broken paving slab outside a King Street shop, or falling into a pothole, can give you grounds for a claim against the council.

Many people assume the council will simply accept responsibility. It rarely does. These claims turn on the council’s own inspection records for the exact road section where you fell. A defect present for months that routine inspection should have caught supports your case. One that appeared just a day before the accident is much harder to pursue. We request those records on your behalf.

Medical Negligence Claims Involving NHS Ayrshire & Arran Facilities

Healthcare professionals in Scotland owe their patients a duty to provide care that meets a reasonable standard. Where treatment falls below that standard, and you are harmed as a result, you may have a claim.

We handle medical negligence claims against NHS Ayrshire and Arran, at University Hospital Crosshouse and East Ayrshire Community Hospital, and at GP practices and dental surgeries across the area. Claims can also be brought against individual practitioners or private providers.

Common grounds for a medical negligence claim include:

  • Surgical errors, such as damage to surrounding tissue or operating on the wrong site
  • Delayed or misdiagnosis, where earlier diagnosis would have produced a better outcome
  • Failure to obtain proper consent about material risks before treatment
  • Negligent dental treatment

These claims require reports from independent medical specialists, so they take longer to resolve than a road traffic claim.

Serious, Catastrophic, and Fatal Injury Claims

Where an injury changes your life permanently, compensation is about far more than the injury itself. It is about funding the care, equipment, and adaptations you will need for decades ahead. We manage claims involving traumatic brain injury, spinal cord damage, paralysis, and severe burns.

Interim payments are money provided before a claim finally settles. For catastrophic injuries, this is often the most valuable part of the case, because you may need rehabilitation or an adapted home immediately and cannot wait years. We apply for interim payments at the earliest sensible point so that rehabilitation can begin while the rest of the claim continues.

Fatal accident claims: If someone close to you died as a result of another person’s negligence, their relatives may be entitled to claim under the Damages (Scotland) Act 2011. Spouses, partners, children, and parents are all covered. A fatal accident claim brought by an East Ayrshire family typically addresses loss of financial support, the services the deceased provided, and grief and loss of society.

Who Is Responsible for Your Personal Injury in Kilmarnock?

Responsibility falls on the person or organisation that breached their duty of care, causing your injury.

This is not always obvious, but it typically includes:

  • Another driver
  • An employer who provided poor training or defective equipment
  • A business or landlord who failed to keep premises safe
  • A healthcare provider
  • A product manufacturer
  • East Ayrshire Council, where a defect in a road or footpath it maintains caused your injury

Where two or more parties share the blame, Scots law on delictual liability allows you to recover your full loss from any one of them. The courts then sort out the split between defendants, so a dispute about fault between them does not delay your compensation.

Insurers deny liability routinely, even where fault looks plain. Every claim is fully investigated, which can include visiting the scene, obtaining CCTV, and taking witness statements.

Gathering Evidence for Your Kilmarnock Injury Claim

Good evidence separates a claim that settles properly from one that stalls. Here is what to do from the outset:

  • Take clear photos of where the accident happened and of any injuries you have. Continue taking photos as you recover, as bruising often looks much worse a few days later than it did immediately after the accident.
  • Get witness details. Collect names and contact information before people move away.
  • Report it at work. Make sure the accident goes in the accident book and ask for a copy.
  • For road traffic accidents, Police Scotland will hold the official report. You do not need to worry about tracking this down yourself, as your solicitor will request a copy directly from them on your behalf.
  • CCTV footage is incredibly valuable evidence, but you need to act quickly. Most camera systems automatically delete and overwrite their footage after a month. Let us know immediately if there were cameras nearby, and we will send out urgent requests to save the video before it is lost.

You do not need all of this before speaking to us. Gather what you can, and we will obtain the official records, including your medical notes, with your written consent.

How the Personal Injury Claim Process Works in Scotland

Step 1: Initial consultation

We listen to what happened, look at the evidence, and tell you honestly whether you have a claim. This is free and carries no obligation.

Step 2: Instruction and investigation

The funding arrangement is confirmed in writing. Once that is sorted, your solicitor officially notifies the responsible party that you are making a claim and begins gathering the evidence needed to build your case.

Step 3: Medical assessment

An independent expert examines you and produces a report on your injuries and prognosis. That report drives the value of your claim.

Step 4: Negotiation

Your solicitor will handle the tough negotiations with the insurance company, but you remain in control. For the majority of injury claims under £25,000, there is a formal process designed to push both sides toward an early settlement. We will let you know right away if these rules apply to your claim.

Step 5: Court proceedings and settlement

If the insurer refuses to agree to a fair settlement, your solicitor will take the case to court for you. Even if this happens, you will rarely need to attend any hearings yourself until the very final stage.

Throughout the entire process, you will deal with the exact same team. We promise to keep you updated on where your case stands, so you never have to chase us for answers.

Local Court Jurisdiction: Kilmarnock Sheriff Court vs. the National Personal Injury Court

Where your claim is heard depends mainly on its value.

Kilmarnock Sheriff Court, St Marnock Street, handles a substantial volume of personal injury business, including lower-value claims.

The All-Scotland Sheriff Personal Injury Court, now referred to by the court service as the National Personal Injury Court, was established in September 2015 and hears personal injury cases from anywhere in Scotland.

The Court of Session in Edinburgh takes the largest and most complex cases.

Under Section 39 of the Courts Reform (Scotland) Act 2014, claims not exceeding £100,000 can only be brought in the sheriff court. Only claims above that figure start in the Court of Session.

For context, in 2024/25 there were 11,129 personal injury claims raised in Scottish courts, an increase of 17% on the previous year. Of these, 6,893 were dealt with by the National Personal Injury Court, with the remainder proceeding in local sheriff courts like Kilmarnock or, for the biggest claims, the Court of Session.

You do not need to determine which court applies to you. The right venue is selected for you, and every hearing, filing, and piece of correspondence is handled on your behalf. Most clients never enter a courtroom.

Calculating Compensation in Scotland: Solatium and Patrimonial Loss

Personal injury compensation in Scotland has two main parts.

Solatium covers the injury itself, including pain and suffering and loss of amenity, which refers to the activities and enjoyment you can no longer access. The figure is set against the seriousness of your injury, your age, how long symptoms are expected to last, and comparable Scottish awards.

Patrimonial loss covers your financial losses, past and future:

  • Loss of earnings, including wages lost during recovery and any reduction in future earning capacity. Where an injury has ended a career, this can be the largest single element of the claim.
  • Care costs, including unpaid care provided by family members
  • Treatment, equipment, and travel to appointments.

No online compensation calculator can produce an accurate answer. Two people with the same injury can receive very different amounts depending on age, occupation, and ongoing needs. What we can do is give you a realistic range based on the specific facts of your case.

Time Limits for Personal Injury Claims in Scotland

In Scotland, you generally have three years from the date of your accident to raise a claim. This is set by the Prescription and Limitation (Scotland) Act 1973. Once the deadline passes, a claim is likely to be time-barred, however strong it is.

Exceptions to the standard three-year period:

  • Children under 16. The time-limit does not begin until their 16th birthday. A parent or guardian can claim on their behalf before then.
  • Lack of mental capacity. If the injured person lacks the mental capacity to manage their affairs, the three-year deadline is paused. The three-year countdown only begins if and when they regain capacity.
  • Conditions that develop slowly. For asbestos-related disease or vibration white finger, time usually runs from when you knew, or could reasonably have known, that your work caused it. That can be decades after the original exposure.

A narrow judicial discretion under Section 19A of the 1973 Act can allow a claim to proceed out of time where that would be equitable, but this happens very rarely and should never be relied upon.

Even though you have three years to claim, unnecessary delays can severely harm your case. Crucial CCTV footage gets overwritten in a matter of weeks, and witnesses can move away or simply forget important details.

No Win, No Fee Personal Injury Claims in Kilmarnock

Most of our claims are funded through a no win, no fee arrangement, known formally in Scotland as a Speculative Fee Agreement. There are no upfront legal costs, and fees are only payable if compensation is recovered for you.

  • If your claim succeeds, the fee is an agreed percentage of what is recovered, confirmed in writing before you start, with no hidden charges.
  • If your claim does not succeed, no legal fees are payable.

We also check whether you already hold legal expenses insurance, which is often attached to home contents insurance or a bank account.

FAQs

Can I claim against East Ayrshire Council for a slip, trip, or pothole?

Yes. You can make a claim against East Ayrshire Council where it failed in its duty to maintain the road or footpath under the Roads (Scotland) Act 1984. The defect must have been serious enough that the council ought to have repaired it, and present long enough that a reasonable inspection system would have found it.

We will formally request the council’s maintenance and inspection records for the exact location of your fall. Even if the council is ignoring your complaints, their own internal records will often reveal exactly how long that problem was left unfixed, which is the key to proving your claim.

Most claims in Scotland are resolved through negotiation, without a full court hearing. The pre-action protocol for claims under £25,000 is designed to push settlement before proceedings begin.

If your claim does need to be raised in court, claims of £100,000 or less must be brought in the sheriff court. For most East Ayrshire cases, that means Kilmarnock Sheriff Court or the specialist National Personal Injury Court. Every court appearance is arranged and handled for you, and most claims settle without ever entering a courtroom.

No. It is unlawful for your employer to dismiss you or treat you unfairly because you have made a claim. It also helps to know who actually pays: the Employers’ Liability (Compulsory Insurance) Act 1969 requires employers to hold insurance covering injury to their staff, so your compensation comes from that insurer and not from your employer’s operating funds.

Yes. Under the Law Reform (Contributory Negligence) Act 1945, you can still recover compensation even where you contributed to your own accident. Your award is simply reduced in proportion to your share of responsibility. For example, if a court found you 25% responsible and your claim was worth £20,000, you would receive £15,000.

Nothing upfront. Under a Speculative Fee Agreement, no fee is payable unless compensation is recovered. The fee is an agreed percentage of what is recovered, confirmed in writing before you start, with no hidden charges. If your claim is unsuccessful, no legal fees are payable. The initial consultation is free either way.
