What types of surgery can result in a cosmetic negligence claim?

A cosmetic surgery negligence claim is part of medical negligence law and can arise when substandard treatment causes avoidable harm. It can happen after many different types of cosmetic procedures. Common examples include breast augmentation, rhinoplasty, facelifts, eyelid surgery, ear correction, liposuction, brow lifts, dermal fillers, laser treatment and tummy tuck surgery.

We often see claims involving breast surgery mistakes, nose reshaping complications, tummy tuck errors, facelift negligence, ear surgery negligence, and laser resurfacing gone wrong. The key issue is not the procedure itself, but whether substandard treatment, poor aftercare or a failure to explain the risks properly left you with avoidable harm.

You can make a claim whether your treatment was carried out by a cosmetic surgeon or another practitioner. These cases can arise after treatment in private clinics, hospitals and, in some circumstances, the NHS.

Common Reasons for Cosmetic Surgery Compensation Claims

Many cosmetic surgery compensation claims now involve non-surgical aesthetic treatment, not just operations. In Scotland, we often see problems after fillers, anti-wrinkle injections and similar procedures.

Common reasons for a claim include:

These cases do not only happen in clinics. They can also happen in beauty salons or other settings. Even if the practitioner was not regulated, they may still owe you a legal duty of care. If their failings caused harm, you may be able to seek cosmetic surgery compensation.

What are the risks of cosmetic surgery negligence?

When cosmetic surgery negligence happens, the damage can affect both your body and your mental health. Some problems are visible straight away, while others become clear days or weeks later.

Common risks include:

Not every injury is physical. Many people also struggle with the emotional impact, especially if the result changes their appearance or leaves them needing more treatment.

A lack of informed consent can also be part of the problem. If you were not properly told about the key risks, likely outcome or other options before treatment, and you then suffered harm, that could form part of a negligence claim.

What will happen when I make a claim?

When you contact us, we will begin with a free, no-obligation discussion about what occurred, how you were affected, and whether you have a claim. We will also explain the claims process and discuss funding options, such as whether the solicitors we recommend can act on a no-win, no-fee basis.

If your case can move forward, we will help gather the key evidence. That can include your GP and hospital records, details of the treatment you received, and date-stamped photographs showing your appearance before and after the procedure. These photos can be extremely useful in cosmetic cases, especially when scarring, asymmetry or other problems become more noticeable over time.

Your case may also need an independent medical report. This allows an expert to look at the care you received, say whether it fell below a proper standard and explain what treatment, recovery or long-term effects you may now face. If needed, a medical negligence solicitor can also use this evidence to value your claim properly.

Once the evidence is gathered, the solicitor handling your case will usually attempt to settle it without going to court. If responsibility is admitted early, it may be possible to seek interim payments to cover treatment or other urgent expenses.

If the other side denies fault or disputes the value of the claim, court proceedings may be necessary. Even so, many cases still settle before reaching a final hearing.

FAQs

Can I claim if the surgery was performed abroad?

Possibly, yes. If your procedure occurred outside of the United Kingdom, you may still be able to make a claim, but these cases are typically more complicated. The answer varies depending on where the surgery was performed, who treated you, who arranged the treatment, and which country’s rules apply.

That is one reason it is important to act quickly. The time limit may not be the same as it would be for treatment in Scotland, and overseas providers may not offer follow-up care to the same standard you would expect in the UK. If your surgery was abroad, it helps to keep your booking papers, consent forms, receipts, photos, and any messages about aftercare.

There is no fixed amount. A claim’s value is typically determined by two factors: the severity of the harm and the real-world impact of the negligence on your life.

For example, compensation may take into account your pain, scarring, emotional distress, and any loss of confidence caused by the outcome. It can also cover the practical cost of what happened, such as lost earnings, travel expenses, care, and the cost of further or corrective treatment.

In simple terms, compensation for cosmetic surgery negligence is worked out by looking at both the injury itself and the financial impact it has had on you.

In Scotland, this type of arrangement is often called a speculative fee agreement. It means the solicitor’s fee depends on the outcome of the case, rather than being paid in the usual way from the start.

If the claim succeeds, there is usually a success fee to pay under the agreement. If the claim does not succeed, you would not usually pay your own solicitor’s fee, although there may still be other costs to consider, such as outlays.

In Scottish personal injury claims, you are not usually expected to pay the other side’s expenses unless the court removes that protection, for example, because of fraud or other serious misconduct. Because of that, the solicitors we connect you with will explain the funding terms clearly and discuss whether insurance is needed before anything moves forward.
