My insurance company recommended a firm that charged 30% and had poor reviews. I went with Hamilton Douglas instead, who charged far less and were completely transparent. They were professional, communicative, and secured me an excellent settlement. Do your research and pick them.

Do I Have a Personal Injury Claim in Angus?

An accident and an injury do not always lead to compensation. There must usually be some evidence that another person or organisation failed to take reasonable care and that this failure caused your injury.

Your solicitor will look at four main issues:

  • Duty of care: Was the other party responsible for taking reasonable care of your safety?
  • Negligence: Did they fail to meet the standard expected in the circumstances?
  • Causation: Did that failure cause or worsen your injury?
  • Loss: Did you experience pain, lose income or incur other costs because of the injury?

The responsible party could be a driver, employer, contractor, business, property occupier or public authority. Each type of claim has its own legal and factual considerations.

Responsibility is often disputed at the beginning. Photographs, CCTV, witness accounts and accident records can help show what happened, even if the other party gives a different version of events.

You may still be able to claim if you were partly responsible. This is called contributory negligence in Scottish law. It can reduce the compensation you receive, but shared responsibility does not always prevent a claim.

When we assess your case, we look at the accident date, how the injury happened and what evidence is likely to be available. We will also ask about previous medical conditions because an accident can sometimes worsen an injury or illness that was already present.

Types of Personal Injury Claims We Handle Across Angus

The type of accident affects who may be responsible and what evidence will be needed. You can read about the types of personal injury claims we handle, including road accidents, workplace injuries, accidents in public places and medical negligence claims in Scotland.

Some claims involve severe injuries that change a person’s life for years. Brain injuries, spinal damage, severe burns and amputations may lead to ongoing care, rehabilitation or changes to the injured person’s home and working life.

Road Traffic Accident Claims in Angus

Drivers, passengers, motorcyclists, cyclists and pedestrians can all be injured in road collisions. Claims can also involve taxis, delivery vehicles, farm vehicles and other commercial traffic. On rural Angus roads, particularly single-track routes in Strathmore and the Mearns, slow-moving tractors, combines and livestock trailers can pose a significant collision risk. This is especially true during planting and harvest seasons, when agricultural machinery moves regularly between farms and fields.

Passengers are sometimes unsure whether they have the right to claim. A passenger may be able to seek compensation if another road user caused the crash, including the driver of the vehicle in which they were travelling.

According to Department for Transport road casualty statistics, 123 people were injured in reported road collisions in Angus during 2025. Of these, 55 were killed or seriously injured, including seven fatalities.

The figures only cover collisions reported to the police, so they do not represent every road injury in Angus.

Most road claims come down to one driver doing something wrong, whether that is speeding, overtaking badly, losing concentration or simply not seeing someone in time. In Angus, two roads stand out for their collision history. The A90 between Dundee and Stonehaven is one of the region’s busiest routes, and junctions near Laurencekirk have been flagged as problem areas for years. On the coast, the A92 between Arbroath and Montrose has its own concern at the Inverkeilor rail bridge, a location that has been the scene of serious accidents linked to the road layout.

If you can, keep photographs of the road and vehicles, witness details, dashcam footage and insurance information. It is also worth keeping a note of the police accident number if you reported the collision.

Seek medical attention for any injury or new symptom. Medical records can help show when the symptoms began, what treatment you needed and whether the injury continues to affect your work or daily routine.

If the drivers disagree about what happened, the solicitor can compare their accounts with the road layout, vehicle damage, witnesses and available footage. A disputed version of events does not mean the claim has to stop.

Workplace, Construction and Industrial Injury Claims in Angus

Workplace injuries can happen after falls, machinery accidents, unsafe lifting or exposure to harmful substances. Often, these accidents happen because workers haven’t been properly trained, equipment is faulty, or they haven’t been given the correct safety clothing.

If you were injured in an accident at work, report it and make sure that the accident-book entry describes what happened accurately. Keep copies of fit notes, wage information and messages about your absence.

Your colleagues may have seen the accident or know about earlier problems with equipment or working conditions. Tell us about any risk assessments, training records or maintenance documents that may exist. There is no need to take confidential documents from your workplace, as your solicitor can request them through the proper channels later.

A claim is normally dealt with by the employer’s liability insurer. You are not usually asking a manager or supervisor to pay compensation personally.

Many people worry that making an accident at work claim will affect their job. A personal injury claim and your employment rights are separate issues. Keep a written record if your duties, hours or treatment change after the accident, and seek employment advice if you become concerned.

Farm and Agricultural Accident Claims in Angus

Farming is a major part of working life in rural Angus. The Scottish Agricultural Census 2025 recorded an agricultural workforce of about 66,800 people across Scotland.

Farming is a demanding job that regularly involves heavy machinery, unpredictable livestock, and moving vehicles. Here in Angus, accidents often involve harvest machinery in the arable lands of Strathmore and the Mearns, or livestock handling injuries in the glens. These accidents are frequently caused by unsafe equipment, falls from height, or farm tracks that have not been properly maintained.

Employees are not the only people who may have a claim. Contractors, delivery drivers and visitors may also be owed a duty of care while working on or visiting agricultural premises.

Figuring out who is at fault depends on who was actually in charge of the work, the equipment, or the specific area where the accident occurred. For example, an outside contractor might be running one part of the job, but the farm owner could still be responsible for the overall safety of the yard and the machinery being used.

Try to record the exact location, the task you were carrying out and the equipment involved. Photographs, witness details and the make or model of machinery can all be useful. Employment or contracting documents may also clarify who was responsible for the work.

Do not restart or test damaged machinery to gather evidence. Tell us where it is and what happened so your solicitor can decide whether an inspection is needed.

Slips, Trips and Public Liability Claims in Angus

Slips and trips can happen in shops, restaurants, car parks, leisure venues and rented properties. Claims may also involve pavements or other public areas.

The Occupiers’ Liability (Scotland) Act 1960 deals with the responsibility of people and organisations that control premises. An occupier may be an owner, tenant, business or public body.

Falling on someone else’s property is not enough on its own to prove a claim. The condition of the area and how long the problem was present will need to be considered. Cleaning, inspection and repair records may also become relevant.

Photograph the defect or problem if it is safe to do so. Take one image showing the wider location and another showing the defect clearly. If possible, include something that helps show its size or depth.

Report the accident and keep any reference number you receive. If someone saw what happened, ask for their name and contact details.

How the Personal Injury Claims Process Works in Scotland

If you have never made a claim before, the process can feel unfamiliar. We explain each stage as the case moves forward, but most claims begin in the same way.

Starting with your account

We first need to understand what happened, when it happened and how you were injured. You can contact us even if you do not have every photograph, letter or medical record.

We will check the likely deadline and look at who may have been responsible. If the claim is suitable, a specialist Scottish solicitor will review your legal position and take the required steps.

Gathering evidence and contacting the insurer

Your solicitor may collect records from your employer, medical providers, witnesses or other organisations. Road claims can involve police accident reports and vehicle evidence, while workplace claims may require training or maintenance records.

The responsible party or its insurer is then notified. The insurer may accept responsibility, reject the claim or argue that you were partly at fault.

Assessing your injuries

A medical report is usually needed before the claim can be valued. The medical expert will consider your injury, treatment and expected recovery.

Be open about your symptoms and any earlier health problems. The purpose of the report is to give an accurate account of how the accident affected you.

Serious injuries may require reports from more than one specialist. It can take time to understand whether further treatment, care or rehabilitation will be needed.

Negotiating compensation

Once enough evidence is available, the solicitor will value the injury and related financial losses. The insurer may make an offer, which the solicitor will compare with the medical reports and proof of loss.

Where responsibility has been accepted, it may be possible to request an interim payment. This is an early part-payment of compensation that can help with immediate costs while the rest of the case continues. It is not available in every claim.

When court proceedings are needed

Many claims settle through negotiation. If responsibility or the value of the claim remains disputed, the solicitor may recommend raising proceedings in a Scottish court.

Starting a court action does not mean the case will definitely go to a final hearing. Negotiations can continue while the court process is underway.

What Evidence Do I Need for a Personal Injury Claim?

Start with anything that helps show what happened and how the injury has affected you.

Useful evidence can include:

  • Photographs, video or CCTV
  • Witness names and contact details
  • Accident reports or accident-book entries
  • Medical records, fit notes and prescriptions
  • Police or insurance information
  • Wage records, receipts and other proof of loss

Keep the original files where possible. Edited photographs and screenshots may not contain the same information as the originals.

Your own medical records are vital because they prove when your symptoms started and how they progressed. Later on, your solicitor will arrange for an independent medical expert to examine you and provide a detailed report on your long-term recovery.

It can also help to keep a short diary. Record appointments, time away from work and activities you are struggling with. There is no need to write something every day.

Do not assume that a claim is impossible because you have no photographs or witnesses. Accident reports, medical notes or records held by the other party may still help.

Be careful about posting details of the accident or your recovery on social media. Insurers sometimes review public posts when investigating claims, and may use your posts as evidence to dispute the severity of your injuries or reduce the value of your compensation.

How Is Personal Injury Compensation Calculated in Scotland?

Scottish personal injury law uses two terms that can sound more complicated than they are: solatium and patrimonial loss.

Solatium is compensation for the injury itself. It covers physical pain, emotional suffering and loss of amenity, which means the loss of activities or independence you previously enjoyed.

Patrimonial loss covers the financial effect of the injury. This could include lost earnings, travel expenses, treatment costs or care provided by someone else. Serious injuries may also lead to claims for specialist equipment, home adaptations and future support.

Your solicitor will use medical evidence to understand how long the injury is likely to last. Wage records, invoices and receipts are then used to calculate the financial losses.

Keep proof of expenses as they arise. A cost may be reasonable, but it can still be difficult to recover if there is no record of it.

There is no standard payment for a diagnosis. Two people with similar injuries may receive different amounts because their recovery, employment and daily lives have been affected differently.

Personal Injury Claim Time Limits in Scotland

Most Scottish personal injury claims have a three-year time limit. Court proceedings usually need to begin within three years of the accident or the date on which the injured person first became aware of the relevant facts.

The rules are set out in the Prescription and Limitation (Scotland) Act 1973.

The date of knowledge can become relevant when an injury or its connection to another party’s actions was not clear at first. However, the court will not usually extend the deadline just because you were unaware that you only had three years to claim.

Different rules can apply to children under 16, people affected by certain forms of incapacity and claims following a death. A court has some discretion to allow a late claim, but there is no guarantee it will do so.

Speaking to an insurer does not necessarily stop the clock. It is always best to seek legal advice early so your solicitor has plenty of time to check your exact deadline and gather the right evidence.

No Win No Fee claims in Angus

For an eligible claim, the solicitor may offer a No Win No Fee arrangement. In Scotland, this will often take the form of a success fee agreement.

You will not pay the solicitor’s professional fee upfront. If the claim succeeds, an agreed percentage may be deducted from the compensation.

Scottish regulations set the following maximum success fees for personal injury cases:

  • 20% of the first £100,000 recovered
  • 10% of the next £400,000
  • 2.5% of any amount above £500,000

These maximum rates include VAT. Your agreement may provide for a lower percentage, so check the actual rate rather than assuming the maximum will apply.

The written terms will explain what happens if the claim is unsuccessful. They will also cover medical-report costs, court expenses, insurance premiums and any charge that could arise if you end the agreement early.

We will go through these terms before you decide whether to make a No Win No Fee claim.

Why Choose Us For An Angus Claim?

We work alongside personal injury lawyers local to Angus whose experience fits the accident and injuries involved. A complex agricultural injury may need different experience from a road collision or straightforward slip claim.

You will receive updates when the insurer responds, medical evidence arrives, or an offer is made. We will also explain if evidence changes the strength or value of the case.

The solicitor’s client-care letter will confirm who is acting for you, how the claim will be funded and how to raise a complaint. Read it carefully and ask about any term you do not understand.

We cannot promise that a claim will succeed or predict its value before the evidence has been reviewed. Our aim is to give you a clear view of your position as the case develops.

FAQs

How long do I have to make a personal injury claim in Angus?

Most Scottish claims have a three-year time limit, although exceptions apply. Ask for advice early so the correct deadline can be checked.

Yes. You may have a claim if Angus Council was responsible for the area and failed to repair a known defect within a reasonable timeframe.

Possibly. The solicitor will check why you were on the site, who controlled the work or equipment and whether reasonable safety measures were taken.

Making a workplace claim does not automatically mean you will lose your job. Record any change in how you are treated and seek employment advice if you are concerned.
