My insurance company recommended a firm that charged 30% and had poor reviews. I went with Hamilton Douglas instead, who charged far less and were completely transparent. They were professional, communicative, and secured me an excellent settlement. Do your research and pick them.Verified by TrustindexTrustindex verified badge is the Universal Symbol of Trust. Types of Accident Claims We Handle Across the Forth Valley
Many people realise that the types of personal injury that can lead to a valid civil claim in Scotland are broader than they think.
Our solicitors handle civil claims arising from negligence, breach of duty of care, and liability, whether the responsible party is an individual, an employer, a business, or a public authority. The connecting principle is simple: a third party owed you a duty of care, breached it, and caused your injury or loss.
Below are the principal claim categories we manage for clients across Stirlingshire and the Forth Valley.
Road Traffic Accidents on Stirlingshire Roads
Road traffic accident claims are the most common category of personal injury litigation in Scotland.
If you have been injured in a collision on any road in the Falkirk Council area, including the M9, the A9, or the A803 through Larbert and Stenhousemuir, you may be entitled to claim compensation from the at-fault driver’s insurer.
In an RTA claim, the other driver’s motor insurance policy meets the award, not their personal finances. This applies equally to car occupants, motorcyclists, cyclists, and pedestrians.
Key claim types include:
- Whiplash and soft tissue injuries from rear-impact collisions
- Fractures, head injuries, and orthopaedic trauma from high-speed impacts
- Pedestrian and cycling knockdown claims on Falkirk town centre roads
Where the at-fault driver is uninsured or cannot be traced, your claim may be directed to the Motor Insurers’ Bureau (MIB). It is important to understand that accepting an early settlement offer from the other party’s insurer, without independent legal advice, may result in significantly undervalued compensation. Consult a solicitor before responding to any such approach.
Workplace Accidents and Industrial Injuries
Employers in Scotland have a legally enforceable duty of care under the Health and Safety at Work etc. Act 1974.
The Falkirk Council area has a diverse industrial base. The petrochemical and refinery facilities at Grangemouth are among the most significant industrial concentrations in Scotland. The area also supports substantial manufacturing, construction, logistics, and agricultural activity.
Where a worker sustains injury due to inadequate risk assessment, insufficient PPE, defective equipment, or unsafe conditions, an injury at work claim may be pursued against the employer’s liability insurer.
A question our solicitors hear often is whether bringing a claim will result in dismissal. The answer is clear: dismissal or detrimental treatment because an employee has brought or indicated an intention to bring a personal injury claim is unlawful.
Common claim types include:
- Factory and manufacturing accidents from inadequate machine guarding
- Construction site injuries from falls from height or falling objects
- Manual handling injuries caused by inadequate employer training
Specialist personal injury solicitors often deal with employer liability claims, which are subject to specific procedural considerations. Our solicitors will advise on the appropriate forum from the outset.
Medical and Dental Negligence
A claim for clinical negligence is where a healthcare professional has provided treatment below the standard at which a reasonably competent practitioner would have provided it and this has caused identifiable harm to the patient.
We understand that people who have experienced poor medical care often feel dismissed or unsure if their experience is real. NHS Forth Valley provides health care services in Falkirk, Stirling and Clackmannanshire, and its main acute hospital is Forth Valley Royal in Larbert.
If you have received treatment through NHS Forth Valley, your local GP practice or a dental surgery in the Falkirk area that has fallen below an acceptable standard, you may have a claim for medical negligence compensation.
Common grounds include:
- Misdiagnosis or delayed diagnosis of a serious condition
- Surgical errors or post-operative complications
- Medication errors and inadequate patient safety protocols
One of the first practical steps is obtaining your full medical records. Under the Data Protection Act 2018, you can access these records, and our solicitors will help you with that request early in your claim.
Slips, Trips and Falls in Public Spaces
Public liability law obliges those who occupy or control a property to take reasonable steps to ensure visitor safety.
Falkirk Council is responsible for maintaining roads and pavements that it has adopted and continues to maintain in the council area. Falkirk Council provides reporting routes for pavement defects, including broken slabs, and road defects such as potholes under the Occupiers’ Liability (Scotland) Act 1960.
If you have suffered an injury in a slip, trip, or fall, the following steps will strengthen your public liability claim:
- Photograph the defect immediately, using a ruler or coin for scale
- Report the hazard the same day and retain any incident report
- Obtain contact details of witnesses present at the scene
Council negligence claims require careful handling, as the duties owed by Falkirk Council differ from those owed by a private business. Our solicitors will identify the responsible party and assess your grounds for claim.
How Your Claim Is Processed: Falkirk Sheriff Court and ASPIC
The procedural pathway for a personal injury claim in Scotland is distinct from that in England and Wales.
Claims of £5,000 or less may be pursued in the local sheriff court (for example, Falkirk Sheriff Court) under simple procedure. Claims for personal injury over £5,000 (and certain work-related injury claims over £1,000) fall within the exclusive competence of the All-Scotland Sheriff Personal Injury Court (ASPIC) in Edinburgh, which centralises higher-value personal injury cases in a single specialist forum. Sheriff courts, including ASPIC, have exclusive competence for civil claims up to £100,000; claims above that level are usually raised in the Court of Session.
A common concern is whether court attendance is required. In Scotland, the vast majority of personal injury claims settle before anyone raises proceedings. Where a case does proceed to ASPIC, your solicitor manages all court steps on your behalf, keeping you informed throughout.
The Civil Litigation (Expenses and Group Proceedings) (Scotland) Act 2018 also introduced a Qualified One-Way Costs Shifting (QOCS) regime. This provides that the court must not award expenses against a pursuer who has conducted proceedings appropriately, even if the claim ultimately fails.
Calculating Scottish Compensation: Solatium and Patrimonial Loss
In Scotland, there are two different heads of legal claim under Scots Law which cover compensation for personal injury.
Patrimonial loss, equivalent to special damages in English law, covers quantifiable financial losses. This includes past and future loss of earnings, treatment and rehabilitation costs, travel expenses, and care provided by others.
Solatium is assessed by reference to the Judicial College Guidelines, which provide indicative ranges by injury severity. These figures are applied alongside the specific medical evidence in each case. No solicitor can properly quantify your claim without a formal medical assessment.
| Head of Claim | Scots Law Term | What It Covers |
|---|---|---|
| Pain, suffering & loss of amenity | Solatium | Physical pain, psychological distress, reduced quality of life |
| Past financial losses | Patrimonial Loss (past) | Lost earnings, treatment costs, travel expenses |
| Future financial losses | Patrimonial Loss (future) | Projected loss of income, future care, rehabilitation |
| Services rendered by others | Section 8 / Section 9 claims | Assistance from family members during recovery |
General damages in Scots Law are not awarded on a tariff basis, unlike certain claims in England under the Whiplash Reforms. Personal injury claims in Falkirk are assessed using common law principles and the Judicial College Guidelines, a distinction critical to securing a fair settlement for both Solatium and Patrimonial Loss.

Gathering Evidence for Your Injury Claim
The strength of a personal injury claim is directly proportional to the quality of the evidence supporting it.
Under Scots civil law, the burden of proof lies with the pursuer to demonstrate, on the balance of probabilities, that the defender’s negligence caused the injury. Our solicitors will advise on the specific evidence required, but the following is commonly central to most claims.
A medical report from your GP or a treating clinician at the Forth Valley Royal Hospital forms the evidential foundation. The report should detail all injuries, including minor symptoms, as conditions that appear minor may worsen over time.
Supplementary evidence includes:
- A police report or crime reference number, where Police Scotland attended
- Photographs of the scene, any defect, and visible injuries, taken as soon as practicable
- CCTV footage, requested promptly before automatic deletion occurs
Witness statements from independent witnesses carry considerable weight, particularly in disputed-liability cases. Where an accident occurred at work, the employer’s accident book entry and any RIDDOR report also form part of the evidential record.

Is There a Time Limit for Scottish Personal Injury Claims?
In Scotland, the standard time limit for bringing a personal injury claim is three years from the date of the accident, under the Prescription and Limitation (Scotland) Act 1973.
This deadline, sometimes referred to as a time-bar, is strictly enforced. In the ordinary course, if proceedings are not brought within three years, the claim will be time-barred and the right to compensation lost forever. If you think you have a problem, get legal advice ASAP to protect your position and evidence while it’s still there.
The Act allows specific exceptions. Where the injured person is a child, the limitation period does not begin until age 16, at which point they have a further three years.
For industrial diseases with gradual onset, including conditions linked to Grangemouth’s industrial sector, the three-year period runs from the date of knowledge: when the pursuer first knew, or ought to have known, that their condition was attributable to occupational exposure.
The court retains discretion to allow a time-barred claim to proceed in exceptional circumstances, but this should never be relied upon. If your deadline may be approaching, seek advice without delay.
No Win No Fee Personal Injury Solicitors Servicing Falkirk
This firm operates exclusively on a No Win No Fee basis, described in Scottish legal practice as a Speculative Fee Agreement.
You pay no upfront costs and no legal fees if your claim is unsuccessful. No win no fee services across Scotland have expanded access to civil justice for individuals otherwise deterred by cost. Your solicitor’s fees are contingent on the successful resolution of your claim.
A further protection concerns adverse expenses. Under the QOCS regime, a pursuer who has conducted their case appropriately will not ordinarily be ordered to pay the defender’s expenses, even if the claim fails.
For claims involving greater complexity, Before the Event (BTE) insurance, often included in home or motor policies, or After the Event (ATE) insurance may provide further protection. Our solicitors will assess your existing insurance at the outset.
There is no financial barrier to bringing a claim through this firm. Access to justice is available regardless of your current financial circumstances.
Frequently Asked Questions About Scottish Injury Claims
Can I claim if the accident was partly my fault?
Yes. Partial fault does not automatically extinguish your right to claim compensation.
The applicable principle is contributory negligence, also described as shared liability or split liability. Where a court finds the pursuer partly responsible, the award is reduced by a percentage reflecting that fault. For example, a pursuer found 25% contributorily negligent receives 75% of the assessed value. A qualified solicitor should assess legal fault before you conclude a claim is not viable. (LSI: contributory negligence, split liability, apportionment of fault)
Do I need to visit your office in person?
No. The entire claims process can be managed remotely where you prefer.
We serve clients in Falkirk, Grangemouth, Bo’ness, Denny, and across the wider Forth Valley. Consultations can be conducted by telephone, email, or video call, and documentation exchanged electronically, without any loss of service quality. (LSI: remote legal consultation, claims management Scotland)
How long does the average settlement take?
Straightforward, admitted-liability road traffic claims may settle within three to nine months; complex medical negligence or disputed injury at work claims may take two to three years.
The key variable is whether liability is admitted early. Delays arise where liability is disputed or the claimant has not yet reached maximum medical improvement. Settlement should not be agreed until prognosis is fully established.
What is the difference between a soft tissue injury claim and a more serious injury claim in Scotland?
Scotland applies no tariff-based cap to soft tissue injury claims, unlike the Whiplash Reform tariff in England and Wales.
All personal injury claims, including whiplash, are assessed on individual facts using the Judicial College Guidelines and common law principles. This absence of a tariff regime is a material advantage for claimants under Scots law.
Can I claim medical negligence against a practitioner at the Forth Valley Royal Hospital?
Yes. Claims may be brought against NHS Forth Valley and any practitioner whose care fell below an acceptable standard, causing measurable harm.
This requires demonstrating both substandard care and that it caused the specific harm suffered, typically supported by independent expert evidence. Our solicitors handle this sensitively on your behalf.
