My insurance company recommended a firm that charged 30% and had poor reviews. I went with Hamilton Douglas instead, who charged far less and were completely transparent. They were professional, communicative, and secured me an excellent settlement. Do your research and pick them.

Have You Suffered an Accident in Cumbernauld?

You may have a personal injury claim if another party owed you a duty of care, failed to take reasonable care and caused your injury. Responsibility could rest with a driver, employer, business, local authority, healthcare provider, manufacturer or the person responsible for a property.

Claims can arise from road traffic accidents, workplace accidents, unsafe premises, defective products and negligent medical treatment. Both physical and recognised psychological injuries can form part of a claim when supported by medical evidence.

When reviewing your claim, we will consider:

  • How and where the accident happened
  • Who controlled the vehicle, workplace, premises or activity
  • What safety measures were in place
  • What the other party did wrong
  • How their actions caused or contributed to the injury
  • What medical evidence supports your injuries
  • Whether the claim is within the Scottish time limit

Your health should come first after an accident. Seek appropriate medical attention and report the accident to the police, your employer, the premises operator or another relevant organisation. Keep any photographs, accident reports, witness details, CCTV footage and correspondence.

An initial assessment will help identify who was responsible, what evidence is needed and whether a deadline requires urgent action.

Types of Personal Injury Claims We Handle

Different accidents involve different legal duties, evidence and responsible parties. Our guide to the types of personal injury explains more about the cases we assess.

We manage claims involving road collisions, accidents at work, unsafe premises, serious injuries and medical negligence. Before accepting a case, we review the accident, available evidence, applicable time limit and prospects of proving responsibility.

Road Traffic Accident Claims

You may be able to make a road traffic accident claim if another road user’s negligence caused a physical or psychological injury. We assess cases involving cars, vans, taxis, motorcycles, bicycles, pedestrians, buses, public transport vehicles and HGVs.

Accidents can happen on local streets or major routes serving Cumbernauld, including the M80, A73, A8011 and B8039. To find out who caused the collision, we look at what each road user did, how the vehicles moved and what the available photographs, footage and witness accounts show.

Useful evidence includes:

  • Police reports or accident reference numbers.
  • Photographs of the vehicles and accident location.
  • Dashcam, CCTV or mobile-phone footage.
  • Driver and insurance details.
  • Witness contact information.
  • Vehicle inspection and repair records.
  • Medical records.
  • Proof of lost earnings and related expenses.

As a passenger, you can still make a claim if you were injured due to the negligence of your own driver or another road user. The evidence must still connect the injuries to the accident and identify who was responsible.

People injured by uninsured or unidentified drivers can submit eligible claims to the Motor Insurers’ Bureau. These claims are subject to the Bureau’s own rules, deadlines, and evidence requirements. Further guidance is available from the Motor Insurers’ Bureau.

According to provisional Transport Scotland road casualty figures, North Lanarkshire recorded 208 injury collisions during 2025. These collisions caused 267 casualties, including 3 fatalities and 88 serious injuries.

Workplace Accident and Industrial Injury Claims

You may have a workplace accident claim if an employer, contractor or another responsible party failed to take reasonable care for your safety.

We assess claims involving:

  • Building site accidents.
  • Factory and warehouse accidents.
  • Farm accidents.
  • Manual handling injuries.
  • Forklift accidents.
  • Falls from scaffolding, ladders or platforms.
  • Inadequate personal protective equipment.
  • Defective equipment or dangerous machinery.
  • Exposure to hazardous substances.
  • Industrial disease and occupational hearing loss.

Employers must take reasonable steps to provide suitable training, supervision, equipment and safe working procedures. Accident-book entries, witness accounts, risk assessments, maintenance records and medical evidence can show whether those responsibilities were met.

According to HSE workplace injury statistics for Scotland, an estimated 40,000 non-fatal workplace injuries occur in Scotland each year, based on the annual average for 2022/23 to 2024/25.

Workplace compensation is normally handled through the employer’s liability insurer rather than paid personally by a manager or the company. Learn more about injury at work claims and the evidence you may need.

Slips, Trips and Falls in Cumbernauld

A business, public authority or occupier is not responsible simply because someone falls on its premises. A claim requires evidence that an unsafe condition existed, reasonable precautions were not taken, and that danger caused the injury.

Slips, trips and falls can happen in supermarkets, shops, workplaces, car parks, leisure premises, stairwells, pavements and other public or private locations. Common problems include wet floors, damaged steps, poor lighting, loose flooring, uneven surfaces and obstructions.

Under the Occupiers’ Liability (Scotland) Act 1960, the person or organisation responsible for premises must take reasonable care for visitors.

Important questions include:

  • How long had the danger been there?
  • Did the occupier know, or should they have known, about it?
  • Were reasonable inspection and cleaning procedures followed?
  • Were suitable warnings or barriers provided?
  • Did the danger cause the fall and injury?

After a fall, photograph the cause and the surrounding area if it is safe. Report the accident, ask for a copy of the accident record and keep witness details and relevant receipts.

If you were injured on land maintained by North Lanarkshire Council, the key questions are whether the council knew (or should have known) about the danger, whether they failed to fix it within a reasonable time, and whether that failure led directly to your injury.

A lack of photographs or witnesses does not prevent an assessment. CCTV, accident reports, inspection records, medical notes and other documents can help show what happened.

Serious Injury Claims in Cumbernauld

Serious injuries can affect mobility, independence, employment, relationships and psychological health. Detailed medical evidence is often required because the full effect of the injury may not be known during the early stages of recovery.

Serious injuries can include:

  • Head and brain injuries
  • Neck and spinal injuries
  • Paralysis
  • Amputation
  • Multiple or complex fractures
  • Serious burns and scarring
  • Severe hip and pelvic injuries
  • Life-changing psychological injuries

A serious injury claim can include compensation for pain and suffering, loss of earnings, treatment, rehabilitation, personal care, specialist equipment and home adaptations.

Once the other side accepts responsibility, your solicitor can ask for an interim payment. This is part of the compensation paid early to help with immediate costs, such as treatment, care or lost income. It is not available in every case.

The final settlement should take account of the lasting effect of the injury, including future treatment, care and loss of earnings supported by evidence. If you are worried that a compensation payout might affect your means-tested benefits, we can advise you on setting up a Personal Injury Trust to keep your entitlements safe.

Medical Negligence Claims

A poor result from medical treatment does not automatically mean that negligence occurred. There must be evidence that the care you received fell below an acceptable professional standard and caused harm that could have been avoided.

We assess concerns about treatment provided by GPs, hospitals, dentists, care homes and other NHS or private healthcare providers. These claims can involve a delayed or missed diagnosis, a mistake during surgery, a medication error, a birth injury or a lack of proper follow-up care.

Medical records are the starting point. From there, we typically ask an independent medical expert to look at your case. They will explain what should have happened and whether the mistake caused your injury. This is particularly important if you already had a health condition or several factors affected the outcome.

Read our guide to find out when you can claim medical negligence compensation and what we need to carry out an initial review.

What Evidence Do I Need for a Personal Injury Claim?

You do not need to collect every possible document before asking for help. Start with anything that records what happened, the injuries you sustained and the money you have lost.

Useful evidence includes:

  • The date, time and location of the accident.
  • Photographs or videos of the scene, cause of the accident, vehicles or visible injuries.
  • An accident report, accident-book entry or police reference number.
  • Names and contact details for witnesses.
  • Records from your GP, hospital or rehabilitation provider.
  • Emails and letters from an employer, insurer or other organisation.
  • Payslips or employment records showing lost income.
  • Receipts for treatment, medication, travel, care or damaged belongings.

Report the accident as soon as you can and ask for a copy of the accident record. Check that the details are accurate before signing it.

Your health comes first. Seek medical help and follow the advice you receive. Your medical records will also show when your symptoms began, what treatment was needed and how the injury affected your recovery.

What Compensation Can I Claim?

Personal injury compensation in Scotland usually has two parts: solatium and patrimonial loss.

Solatium is compensation for the injury itself. It covers pain, suffering and the effect the injury has had on your everyday life, such as disturbed sleep, reduced mobility or being unable to take part in your usual activities.

Patrimonial loss covers the financial effect of the injury. Depending on your circumstances, this can include:

  • Income you have already lost
  • Future loss of earnings
  • Treatment, prescription and rehabilitation costs
  • Travel to medical appointments
  • Help with personal care or household tasks
  • Mobility equipment and other living aids
  • Adaptations to your home or vehicle
  • The cost of repairing or replacing damaged belongings

Keep receipts, invoices, payslips and other records of what you have spent or lost. Compensation can also cover necessary care provided without payment by relatives or friends.

The compensation amount is personal to you. Two people with similar injuries can receive different settlements because their work, symptoms, recovery and future needs are different.

Are There Time Limits for Personal Injury Claims in Scotland?

For most personal injury claims in Scotland, you have three years to begin court proceedings. The clock normally starts on the date of the injury. A later starting date can apply if you did not know about the injury or its possible cause straight away.

The general rule appears in section 17 of the Prescription and Limitation (Scotland) Act 1973. Exceptions and different rules apply in some cases, including when:

  • The injured person was under 16
  • The injured person lacked legal capacity during the relevant period
  • The injury or its possible cause became apparent later
  • The case involves a fatal accident
  • A court is asked to allow a late claim under section 19A
  • The claim falls under a separate compensation scheme with its own deadline

How No Win No Fee Funding Works in Scotland

Eligible personal injury claims can be handled under a No Win No Fee arrangement. In Scotland, the terms are set out in a written success fee agreement, which can also be called a Speculative Fee Agreement.

Before work begins, the agreement will explain:

  • What counts as a successful claim
  • Whether you need to pay anything upfront
  • How medical reports, expert evidence and court fees will be funded
  • What success fee will be deducted if compensation is recovered
  • Whether an insurance premium applies
  • What happens if you end the agreement early
  • What you may need to pay if the claim is unsuccessful

If your claim succeeds, the agreed success fee will be deducted from your compensation. Under the Scottish success fee regulations.

The fee, including VAT, cannot exceed:

  • 20% of the first £100,000 recovered
  • 10% of the amount between £100,000 and £500,000
  • 2.5% of any amount above £500,000

These are maximum rates, and the agreed fee can be lower. Your agreement will explain how the fee will be calculated and which part of your compensation will be included.

If the claim is unsuccessful, you will not normally pay the solicitor’s fee or the case expenses covered by the agreement. Case expenses can include medical reports, expert fees, court charges and the cost of obtaining records. Insurance premiums or charges resulting from ending the agreement early may be treated differently, so check the written terms before proceeding.

Frequently Asked Questions About Scottish Injury Claims

Can I Make a Personal Injury Claim in Cumbernauld If the Accident Was Partly My Fault?

Yes. You can still make a claim if you were partly responsible. If responsibility is shared, your compensation will be reduced to reflect the percentage of fault placed on you.

Not every claim reaches a court hearing. Many settle through negotiation.

Seek appropriate medical attention and follow professional advice. Keep your appointment, prescription and rehabilitation records. Call 999 in a medical emergency.

The employer’s liability insurer usually handles and pays an accepted claim. The insurer will investigate the accident, the employer’s responsibilities and the medical evidence.

A supermarket can be responsible if it failed to take reasonable precautions against a known danger and that danger caused your injury. Photographs, CCTV, accident reports and inspection records can help prove what happened.

No two claims take the same amount of time. A straightforward claim can settle once responsibility and the medical evidence are agreed. Serious injuries, disputed responsibility or court proceedings usually make the process longer.

The best place to start is simply by reaching out to us for a free assessment. We’ll ask you to share whatever information you already have on hand (like accident reports, photographs, or medical notes) so we can figure out exactly how to help.
