A client first contacted us after being injured in a rear-end road traffic accident. Liability for the first crash was admitted early, but before the medical evidence was completed, she was unfortunately involved in a second accident, which made her symptoms worse.
This created a more complex situation, because it was necessary to show which injuries were linked to the first accident and which had been made worse by the second. Alongside physical pain, she also developed travel anxiety that affected her confidence as a passenger and driver.
We helped make sure the case was directed to the right legal team and that the medical evidence dealt properly with both accidents. An orthopaedic expert was instructed to assess her injuries and give a view on how each accident had contributed to them. A psychiatric expert also reported on her anxiety symptoms and recommended treatment to support her recovery.
Once that evidence was presented, the insurers for both accidents accepted the medical apportionment. The first accident settled for £4,750, while the second accident settled for £8,250, reflecting the fact that it had worsened her physical symptoms and contributed more significantly to her travel anxiety. The insurers also agreed to fund a course of CBT to support her recovery.
